INFORMATION TO THE USER

ALDAJO TRADING, S.L., informs you that, according to the provisions of the General Regulation (EU) 2016/679, of data protection, (RGPD) and in the L.O. 3/2018 of data protection and guarantee of digital rights (LOPDGDD), we will treat your data as we reflect in the present Privacy Policy.

In this Privacy Policy we describe how we collect your personal data and why we collect it, what we do with it, who we share it with, how we protect it and your choices regarding the processing of your personal data.

This Policy applies to the processing of your personal data collected by the company for the provision of its services. If you complete any of our forms you must first agree to the terms of this Policy and we will keep a record of that agreement.

2. PURPOSE, LEGITIMACY AND CONSERVATION

We collect and process your personal data through the forms found on our website:

Contact Form

  • Purpose: To answer your requests for information, respond to your requests and answer your queries or doubts.
  • Legitimation: The treatment is based on the unequivocal consent after the completion, acceptance and sending of the form.
  • Retention: Your data will be kept in our databases for a maximum period of 6 months, in the event that there has been no previous contact activity.

Newsletter

  • Purpose: To send you commercial information about our activities and services, including by electronic means.
  • Legitimation: Processing is based on unambiguous consent.
  • Retention: Until you request unsubscription from our advertising mailings.

License Management

  • Purpose: License Management of Walcu CRM (SAAS) (web app, android and iOS app) and Walcu Phone, where the interested party himself gives his data through the proposed form to collect the required information.
  • Legitimation: The processing is based on the execution of a contract to which the data subject is a party.
  • Retention: Until the conclusion of the contract for the purpose for which they were collected, unless the data must be kept by a legal obligation.

Remarketing

  • Purpose: Walcu uses Google and Facebook Pixel services to evaluate the behavior of the Interested Party on the Website and to offer him/her personalized advertisements about Walcu’s services and products on Internet websites, where the Interested Party himself/herself gives his/her data through the navigation on the Website.
  • Legitimation: The processing is based on unambiguous consent.
  • Retention: Until you request unsubscription from our advertising mailings.

Management of licensed applications

  • Purpose: Management of licensed applications (Carwatch, Tasator, Walcu PRO) where the Interested Party himself gives his data through the permissions enabled for this purpose when operating with the applications.
  • Legitimation: The processing is based on the execution of a contract to which the data subject is a party.
  • Conservation: Until the conclusion of the contract with the purpose for which they were collected, unless the data must be kept by a legal obligation.

3. TYPES OF DATA COLLECTED

The types of data requested are:

  • Identification and contact data.
  • Mail synchronization data through IMAP and SMTP as well as the rest of the data that the Interested Party wishes to enter in the tool such as: sms with clients, whatsApps with clients or call records.
  • Communications data such as emails, SMS, Whatsapps, Chats, calls both recordings and records, logs, call logs, SMS logs, phonebook contacts, IP.
  • License plate data and other vehicle data.
  • Fiscal and financial data relating to customers and necessary for the purchase of a vehicle.
  • Professional data (if applicable).
  • Interactions of the Data Subject with the Website and with the remarketing service providers’ advertisements; IP address of the Data Subject; type of browser used by the Data Subject.

In case of automatic collection of data about your visit to our website, it will be described in the cookie policy.

ALDAJO TRADING, S.L. does not collect data considered especially sensitive such as: race or ethnic origin, political opinions or religious or philosophical beliefs, participation in trade unions, health, sexual activity or sexual orientation, biometric or genetic data.

It is the responsibility of each interested party that the data provided are true, accurate, complete and updated and only they will be responsible for any damage or harm, direct or indirect, that may be caused as a result of the breach of such obligation.

In the event that the data provided by a User belongs to a third party other than the one who provides the data, the User must inform the third party of the aspects contained in this Privacy Policy and obtain their authorization to provide their data to ALDAJO TRADING, S.L.

4. EMPLOYMENT PRIVACY POLICY

To send a job application through the “Employment” section of Walcu’s website, the candidate must send his/her Curriculum Vitae to the following e-mail address: info@walcu.com. 

The candidate’s personal data will be processed for the purpose of processing his/her application for our possible vacancies and managing his/her participation in our present or future selection processes. The legal basis for the processing is the unequivocal consent of the candidate when sending his/her data and CV to this e-mail address. The CVs received will be stored in our databases for a maximum of one year.

5. RECIPIENTS OF THE DATA

The data may be communicated to third parties for the provision of various services, as Data Processors, but we will not transfer your personal data to third parties, unless we are required by law or you have agreed with us to do so after informing and accepting it.

We share your information with service providers contracted by (Processors), such as, for example: our hosting service, IT or legal advisors. We contractually require all our processors to only use the personal data provided to us for the purpose intended by the contract and to return or destroy such personal data to us upon termination of the contract.

The provision of services located outside the European Economic Area (international data transfers) is not foreseen.

Data may be transferred due to legal obligation: Tax Agency, Public Administration with jurisdiction, Judges and Courts, etc

6. RIGHTS OF INTERESTED PARTIES

You have the right to request confirmation as to whether we are processing your personal data and, if so, to access such data or request its portability.

You have the right to object to the processing of your data (we will always take into account your objection to receiving advertising) and/or to request the deletion of your data.

You may request the limitation of the processing of your data in the following cases:

  • While the contestation of the accuracy of your data is being checked.
  • If the processing is unlawful, but you object to the deletion of your data.
  • When the school does not need your data, but you need them for the exercise or defense of claims.
  • When you have objected to the processing of your data for the performance of a task carried out in the public interest or for the satisfaction of a legitimate interest, while it is being verified whether the legitimate grounds for the processing outweigh yours.

In addition, you may revoke the consent given at any time. Please note, however, that after honoring your revocation we may continue to communicate with you as necessary to comply with our legal obligations or to perform the contract you have with us.

Any of these rights can be exercised by sending a motivated communication through the channels that we make available to you:

  • E-mail: dpo@walcu.com  indicating in the subject “Data Protection”.

For the correct exercise of your rights, we may ask you to prove your identity by means of a copy of your ID card, or equivalent official document, in case we do not have it previously, in our system, or in case of doubts about it.

The deadline to exercise your right, as a data subject, will be one month from the receipt of the request, which may be extended for two more months in cases of complexity or number of requests received. 

If you consider that we have not treated your personal data in accordance with the regulations, you can contact the Data Protection Delegate at dpo@walcu.com, indicating in the subject: Data Protection Claim.

You can also file a complaint with the Spanish Data Protection Agency (www.aepd.es), when you consider that your rights have not been properly addressed or have been violated.

7. DATA PROCESSOR CONTRACT

We make available to our users the data processor contract that will be attached to the license to use the products offered by Aldajo Trading, S.L.

8. PRIVACY POLICY UPDATE

We strive to continually improve our services, processes and the protection of the rights of data subjects, so we will update this privacy policy periodically. We encourage you to consult it on a regular basis.
